We've been fielding many questions about the recent presidential proclamation. Here are answers to the most common concerns: 

Q: What exactly changed with H-1B visas? 

A: A presidential proclamation issued Friday night introduces a $100,000 fee requirement for new H-1B petitions filed on or after September 21, 2025. This only applies to new filings going forward. 

Q: Are my current H-1B employees affected? 

A: No. USCIS has clarified that existing H-1B visa holders and those renewing their status inside the U.S. are not impacted. Previously filed petitions also continue as normal. 

Q: What about my EB-3 cases and hiring plans? 

A: EB-3 programs are completely unaffected. All EB-3 hiring, petitions, and processing continue exactly as planned with no changes or delays. 

Q: Can I still hire H-1B nurses, MTs, or PTs? 

A: You can continue hiring and interviewing candidates. However, we recommend putting new H-1B petition filings on hold until DHS provides clarification on whether healthcare organizations will receive exemptions. 

Q: Will healthcare organizations be exempt? 

A: We're awaiting official guidance from DHS. Historically, healthcare and cap-exempt organizations have received exemptions from similar restrictions. 

Q: Should I pause my workforce planning? 

A: Absolutely not. Your hiring strategy can continue, especially for EB-3 and TN pathways which remain fully available. We recommend having multiple immigration pathways as part of a robust workforce strategy.
